FOUNTAINS AND SOLDIERS' MONUMENT.

(Passed August 16th, 1881.)

AN ORDINANCE for the protection and preservation of the fountain presented to the city of Wheeling, by James W. Paxton, other public fountains in said city and the Soldiers' monument.


SECTION 1. Be it ordained by the Council of the City of Wheeling, That it shall be unlawful for any person to throw sticks, stones or other substances in or upon the fountain presented to said city by Mr. James W. Paxton, or in or upon the soldiers' monument, located at the north east corner of Chapline and l6th streets, or in or upon any part of said fountain or monument, or in or upon any other public fountain of said city, and it shall further be unlawful to climb upon, engrave, deface, mutilate, destroy, soil or injure either said monument or any of said fountains.

SEC 2. Any person offending against any of the provisions of this ordinance shall forfeit and pay to the said city a line of not less than five nor more than one hundred dollars and the costs of prosecution; and if such fine and costs be not paid at once upon the rendition of the judgment therefor, the offender may, at the discretion of the court rendering the judgment, be imprisoned and compelled to labor without compensation at any of the public works or improvements undertaken or to be undertaken by said city, until such fine and costs are fully paid, or for any period not exceeding one year, or at the discretion of the court, the offender may be so fined and also, in addition to such fine, imprisoned and compelled to labor as aforesaid for any period not exceeding one year.

SEC. 3. This ordinance shall take effect from its passage.
